An Australian business seeking to employ a professional architect from the USA and to create a pathway for him and his family to gain Australian permanent residency.

Introduction

Therian Pty Ltd (Therian) is an Australian architectural firm that specialises exclusively in the Animal Health industry. It provides architectural design solutions that maximise the ability of its clients to deliver quality care efficiently. It's projects include new sites, refurbishments, expansions and fit-outs.

Background

Imagine that you are an Australian business that has recruited a professional staff member from overseas and that you need to get the new employee into Australia as quickly as possible as he is critical to ongoing business success. The applicant wishes to be accompanied by his family who are looking at making Australia their home for the long term. Add to this the fact that the new staff member is too old to immediately apply for any permanent residency visa and that the options open to him and his family appear to be very limited if they are to achieve their long-term ambition of starting a new life in Australia.

We were first approached by Therian in late 2017.

The Solution

We advised that the applicant come here on a Visitor Visa to take a look at Therian and to consider all the factors that would influence his decision to move here.

Having met both the applicant and the Director of Therian, we applied for Therian to be approved as a Standard Business Sponsor and then assisted the company to lodge a sub-class 457 nomination. We then went on to submit the sub-class 457 visa application in February 2018. This visa was quickly approved about six weeks later. The visa was for a term of two years.

After a short while in Australia the employee decided that he definitely wanted to seek Australian permanent residency status. This is possible for applicants aged over 45 years of age at the time of application if, at that time, they have worked for their Australian employer for more than three years and, throughout that period, have earned at least the Fair Work High Income Threshold amount.

To achieve the ‘three-year’ requirement, we had to apply for a second Short-term Working Visa (sub-class 482). The second visa was granted in March 2020 while the applicant and his family remained in Australia.

Having worked for Therian for more than three years on the combination of 457 and 482 visas, we applied for his permanent residency in February 2022 and this was granted in mid-June 2022.

The Outcome

The applicant and his family are now all permanent residents of Australia and may be eligible to apply for Australian citizenship within the next 12 months. This was a challenging scenario due to the age of the applicant and the desire of the whole family to remain in Australia for the long-term.

The situation was made particularly onerous for the applicant as he was faced with enforced isolation here due to COVID-related border restrictions on temporary visa holders in place at the time. We were able to help the applicant and family ‘escape’ Australia for a family trip back to the USA by applying for a suitable bridging visa - another aspect to our service.
