It’s a good example of the smooth onshore transition from the sub-class 400 (Temporary Work (Short Stay Specialist) visa to the sub-class 482 (Temporary Skill Shortage) visa. 

It’s also a very good example of how government policy changes very quickly in the migration space and the value of having a professional agent keeping an overview of developments on your behalf.

TorFX needed to fill a specialist FX dealer role quickly and had recently struggled to recruit qualified FX dealers locally on the Gold Coast, Australia. They decided to ask an FX dealer working with an associated company in the UK to join its Australian team. The prospective employee had been working in the financial sector for about 7 years

Background

TorFX already held Standard Business Sponsor status. In checking Torfx's SBS status we were able to remind them to renew it at the appropriate time.

From day one, we were aware that they wanted to stay in Australia for as long as possible and we had given advice in relation to their longer- term skilled pathways. The challenge was that they did not possess the relevant tertiary qualifications, meaning a positive skills assessment would be unlikely, even with 7 years financial markets experience. This fact severely limited their long- term aspirations. Essentially, they were looking at a maximum of 6 years in Australia on three separate 482 visas.

The Solution

Given the urgency of the need in Australia, we advised that the applicant should apply for a sub-class 400 visa.  This visa would allow them to remain in Australia for up to three months. The plan was to get them here as quickly as possible and to then to apply, while in Australia, for a sub-class 482 visa which would allow them to remain in the country for up to two years in their occupation of Financial Market Dealer.

The 400 application was prepared and lodged within a week and was approved within 11 days.

The nomination for the 482 visa was approved within 8 days and the visa application within 4 days. This application was dealt with extremely quickly

The Outcome

The employee is now in Australia on a 2-year, sub-class 482 visa and we are in constant touch with Torfx to guide them and their employee over the next few months and years as regulations with regard to employer sponsored visas evolves
